LEGAL ANALYSIS OF EDUCATIONAL ADMINISTRATIVE DISCIPLINARY PROCESSES

Abstract

The exhaustive study of this scientific article focuses on analyzing Supreme Decree No. 25273, specifically numeral 1 of article 21. Using a descriptive-propositional methodology, the study employed questionnaires and interviews with teachers, district directors, and legal advisors to clarify the current situation. Significant deficiencies were identified in the current composition of the disciplinary tribunals, as they are currently made up of parents, individuals who lack legal training. The findings emphasize the need to reform the current regulatory framework to include a law degree as a requirement for being part of the disciplinary tribunal. The social relevance of the issue has led to the proposal of an amendment decree that addresses these concerns, which would strengthen transparency, legitimacy, and due process in disciplinary proceedings. Furthermore, it is proposed to unify the scattered regulations into a single "Code of Ethics" to improve coherence and regulatory effectiveness.
