The regulatory capacity, understood as the power to issue regulatory instruments of a prescriptive nature, is one of the most important manifestations of public authority, whose complexity and relevance is decisive when defining the identity, form of operation and distribution of the power and authority in state arrangements of a composite nature, generating a complex legal system typical of a decentralized institutional framework, also analyzing the mechanisms developed in doctrine and constitutional jurisprudence in manage of emerging tensions inherent to the coexistence of regulatory subsystems territorial within the same general legal system.
